A coalition of Canadian media organizations has launched a lawsuit against OpenAI, claiming the company’s ChatGPT product infringed copyrights by utilizing their journalism without authorization, according to a Nov. 29 court filing.
The plaintiffs are prominent media outlets, such as CBC/Radio-Canada The Toronto Star and The Globe and Mail. The plaintiffs are seeking damages as well as an injunction that would prevent OpenAI using their content.
OpenAI is accused of profiting off Canadian content by extracting it and selling it without consent. The case was filed at the Ontario Superior Court of Justice.
The group accused:
“OpenAI is capitalizing on the use of our content, disregarding copyright laws and online terms of use.”
OpenAI defends its practices. It says that it trains its AI models using publicly-available information in accordance with the fair use principles and other copyright laws. It also highlighted the company’s partnerships with media organizations, as well as its opt-out option for publishers.
OpenAI spokeswoman told journalists:
“ChatGPT is used by millions worldwide to enhance creativity and solve complex problems. We collaborate with publishers to ensure attribution and offer tools for them to control how their content is engaged with on our platform.”
However, the plaintiffs argue that OpenAI’s activities undermine the value of journalism by repurposing it for commercial gain. They also challenged OpenAI’s reliance on fair use, emphasizing that their journalism is intended to serve the public interest and should not be exploited for profit.
The case is one of many that have been filed against OpenAI, and other AI firms for the use of copied materials in model training. OpenAI told a UK panel earlier this year it was not possible to train their current AI system without copyrighted content.
A number of missteps have also been made by the company, including an admission recently that its engineers accidentally deleted critical data related to AI-training. This case’s outcome could have a significant impact on copyright laws in the AI age as courts struggle to find the right balance between intellectual property and innovation.
